激动网称将对土豆网侵权发起更大规模诉讼
1月6日消息，激动网表示将继续就土豆网侵权内容发起更大规模的诉讼，携手80余家反盗版联盟成员，将年度清算进行到底。
激动网指出，土豆网屡次被诉侵权并败诉，仍长期盗取版权方制作的影视、综艺、音乐、动漫等版权内容获取流量和知名度。此次能够集合众多版权方组成反盗版联盟，正是由于土豆网长期、系统、规模的盗版行为已经激起了公愤。
北京橙天娱乐公司相关负责人则表示，希望土豆网尊重基本的商业规律，尊重劳动者的权益，尊重知识产权，不要因为“版权作为无形资产，即使在传统领域其权利归属的判定也非常复杂”而心存侥幸，不要再动辄把用户当做侵权的借口！
另据透露，反盗版联盟将很快发布联合声明，同时，也将就已取证的侵权作品，继续对土豆提起诉讼，并持续取证工作。同时，也将纳入更多反盗版联盟成员，以系统规模的维权联盟，联合打击系统、规模的盗版行为，直至其完全停止盗版。
对于土豆网昨日发布的声明，激动网代表联盟提出质疑，以下为质疑全文：
1、援引《疯狂的石头》侵权案为例((2007)沪一中民五(知)初字第129号判决书、(2008)沪高民三(知)终字第62号判决书)，土豆网被诉侵权败诉，从既判案例可见，土豆网等视频类网站并不完全适用《信息网络传播权保护条例》规定的“避风港”条款。土豆网故意曲解条例所规定的“避风港”原则之规定，因为在条例所规定的“避风港”规定的第二十三条的但书部分明确规定“网站明知或者应知所上传内容侵权的，网站应该承担侵权责任。”这个已经被法院所认可。
2、土豆网明知其网站内电视、电影全部内容上传的情况比比皆是，此种情况已有异于视频文件爱好者将其原创作品陆续上传之正常情形；且作为个人之网友信息网络传播经相关著作权人合法授权节目之可能性微乎其微. 却在声明中曲解法律条款。土豆网有义务、更应该有能力甄别网站上的内容是否为侵权内容，网站的不作为已构成“帮助侵权”的行为。土豆网构成行为上的明知，法律上的过错，应承担相应的侵权责任。试问，土豆不知道一部没有版权方授权的电影是侵害了版权方的利益吗？“不知道《赤壁》《梅兰芳》《非诚勿扰》是版权作品吗？没有义务、也没有能力对互联网著作权的归属进行逐一判定”？激动网对此感到非常的“困惑和不解”。
3、土豆网声称每月能收到 30000条版权通知的网站，我们建议土豆还是考虑一下自己的商业模式吧！我们为这30000条版权内容感到悲哀，这些内容在没有为版权方创造价值的同时，已经为土豆服务过了。土豆网的CEO王微先生明确在各种场合表示，盗版内容是“工业废水”，提倡使用“正版的黑豆”，既然土豆网有能力辨别什么是版权内容，为什么没有能力屏蔽侵权内容？明知道是废水，为什么不拿掉这些内容？
4、土豆网侵犯激动网的相关影视作品的权利，交涉已久，确如土豆网声明中所述已有相关的和解协议达成，土豆网已经赔付相应的款项给激动网。关于该案件，法院审理并最终庭外和解均为公开信息(如激动网曾于08年上半年针对土豆网的侵权行为提起过的一系列诉讼)，不知该如何保密法，还需请教土豆网。
