视频网站老总盗卖数千部电影版权被判4年刑期

将购买的6000余张盗版美、韩电影光盘转换格式压缩后，北京金互动网络技术有限责任公司 (东方影视娱乐网)总经理杨建委谎称拥有著作权人授权，擅自许可数百家网络公司在网上播映这些电影。近日，认定其构成侵犯著作权罪，宣武法院判处其4年有期徒刑，并处罚金150万元。据悉，这是本市迄今为止发现的最大一起电影侵权案。

      37岁的杨建委是河南省开封市人，研究生学历，被捕前担任北京金互动网络技术有限责任公司总经理及法人代表，并任北京金互动技术开发公司及北京金互动科技有限公司的实际负责人。

      检方指控，2002年至2007年间，杨建委未经著作权人许可，就以其实际掌控的上述几家公司的名义，将美国著作权人所有的5433部电影作品、韩国著作权人所有的979部影视作品，有偿提供给百余家网络公司进行播映及宽带视频点播。其中，中国铁通、中国网通和中国电信旗下的多家分公司都曾与杨建委签订过合作协议。

      2007年10月，接到著作权人的反映后，北京市版权局向北京市公安局经侦处举报了杨建委，后者很快将其抓获。

      庭审时，杨建委否认指控，坚称自己提供的影视作品都已获得了美国电影协会驻京代表处及湖北音像艺术出版社等部门的授权。

      然而，法院审查后证实，美国电影协会驻京代表处本身就不享有这些作品的著作权，其也无权对外授权，而杨建委给别人出具的所谓授权书，也都是虚假的。

      此外，杨公司内的多名职员称，杨提供给其他公司的影视作品，其实都来源于马连道音像城销售的盗版光盘。每次，杨建委都会把想要的电影或电视剧目录详细列出，安排专人到马连道音像城购买便宜的盗版盘。之后，他再找人把光盘全部转换成适合网络播放格式的文件，并在压缩后统一上传到服务器上给其他公司使用。

      最终，认定其行为侵犯了他人的著作权，情节特别严重，已构成侵犯著作权罪，宣武法院做出上述判决。
