3月22日消息，由热播电视剧《我的团长我的团》引发的版权之争成为近日的焦点事件。有观点认为，网络视频可以联播、点播等特性以及视频网站前期的夸大宣传直接影响到了电视台的利益，引发电视台的不满，由此导致电视台向版权方施压，迫使版权方拿掉了视频网站的播放权。业内人士也表示，《我的团长我的团》版权之争的核心问题是，视频网站的快速发展已经对传统电视台的利益构成直接冲击，因此电视台反应激烈。

就在一些视频网站停止播出，并撤下《团》剧相关视频的同时，视频分享网站56网却还在继续播放《团》剧的相关视频，并涉嫌侵权。但56网CEO王建军明确表示，56网不存在侵权可能。他认为，“编辑”产生内容与“用户”上传内容，两者版权责任不同。对于用户上传内容，如果网络服务提供商被告知侵权，只有删除的义务，并不存在侵权，只有当被告知的情况下还不删除才被视为侵权。“避风港”原则中的“通知-删除-免责”已成为视频分享网站常用规避版权风险的借口，但是视频分享网站运营商却忽略了“避风港”原则中“明知”或“应知”的责任。从目前视频网站版权官司的一些判例表明，法律越来越倾向于根据“明知或应知”的原则保护版权人的利益。由于不同法院的执法尺度不同，所以判定的结果也不尽相同。目前，56网再次拿“避风港”原则来说事儿，并没有什么意义。56网现在要做的是如何通过自身建立有效机制来保护版权人的利益，而不是拿一些备受争议的条款做自己的“护身符”。
