法眼快评：视频网站能否逃脱版权降魔杵？

近半年以来，已累计发生多起传统影视公司起诉视频网站视频播放侵权的案件，业内比较知名的几家视频网站先后被诉。究其原因而言，其一，这些视频网站上提供的视频播放文件是没有得到授权的，行为具有违法性;其二，这些被告的视频网站或前或后曾宣布完成数百万美元不等的融资，主体具备赔偿能力。

      背景：

      影视制作公司慈文影视起诉我乐网上传电视剧侵权一案，近期在北京市朝阳区人民法院做出一审判决，前者败诉，我乐网无需对用户上传电视剧行为承担赔偿责任。

      之前，慈文影视将我乐网告上法院，要求其停止侵权行为，并赔偿损失75万元。朝阳区人民法院近期做出一审判决，我乐网作为提供信息存储空间的网络服务提供商，具备《信息网络传播保护条例》有关资格，不应对用户上传电视剧行为承担赔偿责任。

      法眼快评：

      1、近半年以来，已累计发生多起传统影视公司起诉视频网站视频播放侵权的案件，业内比较知名的几家视频网站先后被诉。究其原因而言，其一，这些视频网站上提供的视频播放文件是没有得到授权的，行为具有违法性;其二，这些被告的视频网站或前或后曾宣布完成数百万美元不等的融资，主体具备赔偿能力。

      2、在前述已经发生的传统影视公司诉视频网站的案例中，两者之间兼有胜诉或败诉的案例，换言之，目前，在司法审判实践中，视频网站并非一概承担侵权责任。以“慈文影视诉我乐网(56.com)”案为例，一审法院认为，我乐网无需对用户上传电视剧行为承担赔偿责任。而在“慈文影视诉POCO网站” 案中，广东高院终审认定，被告存在“应当知道”的主观过错，构成帮助直接侵权人实施侵权的行为的共同侵权责任。

      3、而之所以产生不同的判决结果，原因也是多方面的。

      其一，原告选择的诉讼对象不同会产生不同结果。比如有的原告起诉被告侵犯信息网络传播权，而有的则原告则以被告侵犯其他类型的著作权(比如播放权、发行权)为对象;

      其二，原告的举证能力强弱也直接影响到案件结果，比如在“慈文影视诉我乐网”案中，在互联网非实名制的前提下，原告想要证明所谓“用户上传”并非真正互联网用户而是被告的雇员或其他关联人，有相当的技术难度，而在取证方面，从技术上，从上传用户IP地址所属等多方面可以认定这些用户与被告的关系，但由于原告无力搜集，且在原告通过法院申请取证的要求被驳回后，那么，原告胜诉的概率就比较低;

      其三，原告提起的诉讼请求不同也会产生不同结果。比如在“慈文影视诉POCO网站”案，法院认定被告没有直接侵权，而是与上传用户构成共同侵权，而在有些案件中，视频网站会被认定构成直接侵权;

      其四，被告的应诉能力或诉讼技巧高低也对案件结果具有相当影响。比如“慈文影视诉我乐网”案中，被告在应诉时把自己定位为“信息存储空间的网络服务提供商”，按照《信息网络传播权保护条例》的规定，信息存储空间的服务提供者存在法定免责情形，“不对用户上传的视频进行改变(未有视频编辑删减处理)”、“不知或没有合理理由应知用户上传的视频文件侵权”、“未有直接获利”和“履行通知-删除义务”等。

      4、由于《信息网络传播权保护条例》等相关主体规定并不是非常明晰，司法审判实践在个案适用中会略有不同，就“慈文影视诉我乐网”案而言，在法院判决正式生效前，我乐网的一审胜诉并没有太大的价值，尤其在“是否知道或有理由应当知道用户上传的视频文件侵权”的主观认知方面，二审或终审法院都有可能因为原告的其他证据而改变一审判决。

      5、就网络视频行业而言，各大视频网站能否从版权降魔杵下集体逃生呢?一方面，在全球经济下滑的大背景下，视频网站依靠风投度日的生存难度加大，视频网站应该是没有多余的钱扩大版权合作范围的，换言之，视频网站的版权风险依然很大，另一方面，就传统影视公司而言，如果视频网站集体倒下或消亡，对他们并无直接利益可言，他们希望的是视频网站做大盈利，然后再从中分羹，而在当前视频网站的特殊处境下，可以预计一部分影视公司会加快速度、提高力度争取在视频网站集体倒闭前分羹更多收益，而另一部分影视公司会按兵不动静待视频网站实现规模化盈利之时再升手。就这两种情况而言，对视频网站群体都不是好消息。不过，视频网站或普通大众，更希望是视频网站和传统影视公司之间能象门户与报纸之间一样建立起战略合作或资源互换合作，在保证视频网友观看内容效果的前提下，实现双方的共赢。而这需要一些强大有巨大号召力和品牌影响力的视频网站诞生。
